Consumer Product Safety Waivor

The CPSIA signed a law on August 14, 2008 which mandates the following:

Resellers cannot sell recalled children’s products or children’s goods exceeding designated lead limits. Unless resellers have testing or other information to indicate the products being sold have less than the new lead limit, resellers should avoid products that are likely to have lead content.  Products that may contain lead include children’s jewelry, painted wooden or painted metal toys, and flimsily made toys that are easily breakable into small parts.  Among the recalled children’s products to pay particular attention to are cribs, play yards, and dolls and stuffed toys that have button, eyes, noses or other small parts that are not securely fastened and could present a choking hazard for small children.  Those resellers that do sell products in violation of the new limits could face civil and/or criminal penalties.

As a result of the above legislation, LBD is asking all  participating contributors to sign a waiver when they drop off their items indicating  all of your contributed items meet compliance standards.

What does this mean for our consignors?

  • Please double-check all toys and baby items to see if they have been recalled since it is illegal to sell an item that has been recalled.  Detailed steps on how to check your items are below.
  • Do not bring any children’s jewelery to sell at the sale as it oftens has too much lead in it.
  • Anything purchased after February 2009 is safe to consign at our sale.  The new lead limits were in place by then and anything manufactured after this date will be in compliance.

We understand this procedure may be time consuming, but kindly ask for your patience as we all seek to maintain Consumer Product Safety regulations and safeguard our children.

Please use the CPSC Web site ( for information on recalled products before contributing a product.  Instructions on how to search for a recalled product on the website are below.
